TERMS OF USE

Adult accounts, private learning material, AI processing and paid packages

1. Agreement and Operator

These Terms of Use (“Terms”) govern access to the Bhashamitra mobile application and related services (the “Service”). BhashaMitra Edtech Private Limited, having its registered office at 11/3125, Thomas Tower, Infopark Express Highway, Kochi, Kerala 682039, India, provides and contracts for the Service and is referred to as the “Operator”, “Bhashamitra”, “we”, “us” or “our”.

By creating an account, purchasing a package or selecting “I agree”, the adult account holder (“Account Holder” or “you”) agrees to these Terms and acknowledges the Privacy Policy. If you do not agree, do not create an account, purchase a package or submit material. App-store and payment-provider terms may also apply to the transaction.

2. Eligibility and Account Holder responsibility

You may use the Service only if you:

  • are at least 18 years old;
  • use the Service personally, or create and manage a child learner profile only if you are that child’s parent or lawful guardian;
  • provide accurate account, consent and purchase information;
  • create and operate the account, choose the submitted material and supervise any Child Learner’s use;
  • keep credentials and verification codes secure; and
  • ensure that use is suitable for your own circumstances and, where applicable, the Child Learner’s age and circumstances.

You may use the Service personally as an adult learner. You may also create a learner profile for a child for whom you are the parent or lawful guardian. A “Learner” means either you when using the Service personally or a child whose learner profile you lawfully create and manage. A “Child Learner” means a Learner below 18 years of age. The Service is designed primarily for school-age children, particularly those aged 6–15, but adults may use it personally. A child does not independently contract with Bhashamitra. You are responsible for activity through your account except to the extent caused by our failure to apply safeguards required by law.

3. What the Service does

Bhashamitra is a private, AI-assisted learning tool. An Account Holder may submit a PDF or scan of a textbook, notebook, newspaper or other page, select one page for learning and request supported functions for personal use or for a Child Learner:

  • text extraction and in-app display of the selected page;
  • identification and explanation of difficult words;
  • new questions and answers grounded in the selected page;
  • audio of the selected-page text generated only when requested;
  • approved Account Holder-facing progress information; and
  • access to separately owned or licensed Bhashamitra learning content.

The Service is not a digital textbook store, audiobook service, publisher answer key, school, examination authority or substitute for a teacher. It is not designed to convert, reproduce or distribute an entire book.

4. Packages, page allowance and payment

Bhashamitra offers paid monthly packages. The contemplated standard package permits processing of up to 20 selected pages during the displayed package period. Before payment, the checkout screen will state the Operator, price, taxes, page-counting rule, package period, renewal status, expiry or carry- forward rule, cancellation route, refund rule and treatment of failed processing.

A package pays for access to computing, AI processing, speech generation and application functionality. It does not sell or license the textbook, newspaper, notebook or other source material. A page is counted only under the rule displayed before purchase; a failed chargeable processing event will be handled under the displayed credit/refund rule.

App-store purchases are also subject to the store’s billing and refund rules. Nothing in these Terms limits a non-excludable right under consumer law. We will not use pre-ticked consent, concealed charges or other misleading renewal or cancellation practices.

5. Material you submit and the limited service licence

You retain the rights you have in submitted material. You grant the Operator and its contracted processors a limited, non-exclusive, non-transferable (except to those processors), worldwide licence to receive, temporarily host, reproduce, extract, analyse, convert to speech and display the selected-page material solely to provide, secure, troubleshoot and support your requested lesson. This licence does not permit sale, advertising use, general-purpose model training, cross-user reuse or creation of a shared content library. The licence ends when the relevant material is deleted, subject to the disclosed backup cycle, security evidence, legal preservation and statutory records.

For each submission, you represent that you have lawful access and the rights, permission or legally permitted basis necessary for the private learning use requested. You must not submit material in breach of copyright, confidentiality, privacy, contract or another person’s rights. Bhashamitra does not decide whether every individual upload is protected by a copyright exception.

6. PDF, page and audio controls

  • A complete PDF may be received temporarily only to enable the Account Holder to select a page.
  • Only the selected page is processed for the lesson. The remaining PDF/pages are deleted from active systems after extraction and no later than 24 hours.
  • Audio is generated only after an explicit Account Holder request, for the selected page, and for private in-app listening.
  • The Service does not provide a download, export, sharing or audiobook function for user- submitted material.
  • Selected material and audio follow the deletion periods disclosed in the Privacy Policy.

7. Acceptable use

You may use the Service only for lawful, private and non-transferable personal or household learning within the purchased package.

8. Prohibited use

  • submit pirated, unlawfully obtained or unauthorised commercial copies;
  • use the Service to reproduce, narrate, assemble, download, share or distribute a complete copyrighted work;
  • split or repeatedly submit pages to circumvent a complete-work, package, copyright or security control;
  • share account access or output to bypass a publisher, school or subscription restriction;
  • submit identity documents, medical information, confidential records or another person’s private information without lawful authority;
  • submit child sexual abuse material, exploitative, illegal, hateful, violent or otherwise seriously harmful content;
  • upload malware, encrypted payloads, decompression bombs or instructions intended to compromise or manipulate the Service;
  • scrape, resell, reverse engineer or commercially exploit the Service except where a restriction is prohibited by law;
  • misrepresent an affiliation with a publisher, school board or Bhashamitra; or
  • use generated output for cheating, impersonation, harassment or other misconduct.

9. AI-generated output

OCR, difficult-word explanations, questions, answers and audio may be incomplete, inaccurate, ambiguous or unsuitable. Output is generated for learning assistance and is not official, publisher- approved or guaranteed to match a school or examination marking scheme.

The Account Holder should review output before relying on it, especially for assessments, sensitive content or matters requiring professional judgment. A parent or lawful guardian must supervise a Child Learner’s use and review output intended for the Child Learner. The Service is not medical, psychological, legal or other professional advice. Report material errors through Support.

10. Copyright and other rights complaints

A rights owner or authorised representative may complain through the Copyright/Grievance contact identified in Section 21. The complaint should identify the protected work, the affected material or account, the complainant’s authority and reliable contact details.

We may preserve relevant evidence, restrict processing or access, request supporting information, remove material and apply repeat-abuse controls. The account holder may respond with evidence of rights, permission or an applicable legally permitted use. We may act immediately where required by a court, law or serious risk.

11. Bhashamitra intellectual property

The Service, software, interface, branding and original or licensed in-house learning content are owned by or licensed to the Operator. During an active package, we grant you a limited, revocable, non- exclusive, non-transferable licence to use them privately through the app.

No licence is granted to publish, sell, extract at scale, train a model on, create a competing dataset from or otherwise exploit the Service or Bhashamitra content.

12. Privacy

The Privacy Policy explains how Account Holder information, learner profiles, activity, submissions and output are processed. Processing a selected lesson requires the data described there. Child-specific consent and protection provisions apply whenever a Child Learner profile or a child’s personal data is processed. Optional child analytics will not be enabled unless lawfully approved and disclosed.

13. Third-party services

The Service relies on contracted providers, including approved Google and Sarvam products for supported AI, document or speech functions, and providers for hosting, identity, payments, diagnostics, security and support. Their services may have additional terms. We remain responsible for our obligations under applicable law.

14. Availability and changes

We do not guarantee uninterrupted availability. Maintenance, connectivity, device compatibility, provider outages, security events and legal requirements may affect access. We may improve, replace or discontinue features. If a material change adversely affects a paid package, we will provide the notice, credit, refund or other remedy required by the purchase terms and applicable law.

15. Suspension and termination

We may restrict or suspend an account where reasonably necessary for unlawful material, a security or child-safety risk, payment failure, repeated infringement, circumvention or a material breach. We will provide notice and a reasonable opportunity to respond where appropriate; urgent legal, security or safety action may be immediate.

You may cancel future renewal and request account deletion using the disclosed route. Cancellation, package expiry and deletion are distinct: cancellation stops future billing as displayed; deletion is handled under the Privacy Policy.

16. Consumer rights and disclaimers

To the extent permitted by law, the Service is provided on an “as available” basis and AI output is not warranted to be error-free, complete or suitable for every educational purpose. We do not exclude warranties, remedies or rights that cannot lawfully be excluded, including applicable rights under the Consumer Protection Act, 2019.

17. Limitation of liability

To the extent permitted by law, neither party is liable to the other for indirect, special or consequential loss that was not reasonably foreseeable when the package was purchased. Subject to the following sentence, the Operator’s aggregate contractual liability arising from a paid package will not exceed the fees paid for that package and the preceding six months of Service.

The limitation does not apply to fraud, wilful misconduct, death or personal injury caused by negligence where liability cannot be limited, breach of confidentiality or data-protection obligations to the extent they cannot lawfully be limited, infringement by Bhashamitra content, or mandatory consumer remedies.

18. Responsibility for unlawful submissions

To the extent permitted by law, you are responsible for direct claims and reasonable costs caused by material you knowingly submit without lawful authority or by deliberate prohibited use. We will give you reasonable notice and control of the defence where appropriate. This clause does not transfer our own legal responsibility to you or reduce mandatory consumer rights.

19. Governing law, grievances and disputes

These Terms are governed by Indian law. Please first contact grievance@bhashamitra.ai so we can attempt resolution within the period required by applicable law. You retain the right to approach a competent consumer commission, regulator or court where applicable.

Subject to non-excludable consumer forums and other mandatory jurisdiction, courts competent at Kochi, Kerala will have jurisdiction.

20. Changes to these Terms

We may revise these Terms when the Service, package or law changes. We will display the effective date and give reasonable advance notice of a material adverse change. Fresh acceptance will be obtained where required. We will not introduce child advertising, cross-user content reuse, downloads, sharing, model training or materially expanded monitoring through a Terms update alone.
